after 13-year-old andy lopez was shot and killed by a deputy in santa rosa more than a week ago there live - where we're learning more about a second deputy who was on the scene. >> reporter: going to downtown santa rosa a couple of miles away. certainly upset about how in the lopez was killed am. in the center of the police department they shared the information that they learn through interviews with deputies today. we learned today, that there was another deputy with him that was a trainee he was in training at the time of the shooting they were driving north or moreland the attorney was actually driving the car. when they spotted and below is on the side of the road

when we get them. >> catherine: 49ers linebacker aldon smith is out of jail after turning himself in last night on a weapons charge. he surrendered last night to the santa clara sheriff's department. he's charged with illegally possessing an assault weapon and was later released on a 75 thousand dollar bond. smith will be arraigned on >> catherine: the weapons charge november 12th. and a week later - he'll be 'back' in court - to be arraigned on d-u-i charges from a september incident when he drove into a tree. >> catherine: san leandro police have arrested two 18-year-olds accused of murdering an oakland man earlier this month. the suspects -- michael breedlove on the right and maurice martin on the left. >> catherine: police say marvin cruz was shot october 21st on east 14th street.and he later died. martin was detained in sacramento. and later turned over to san leandro police. breedlove was arrested at his oakland home. both men are charged with murder.

worked at a youth center in beverly hills is accused of sexually abusing children. mendel tevel was arrested at a community center in beverly hills, where he was working. >> catherine: the charges reportedly stem from tevel's time as a youth worker in brooklyn. the group says four men accuse him of abusing them as boys.
